§ 1 Scope
These General Terms and Conditions apply to all contracts between Aydin Enterprises, owner Dolunay Aydin, Ludwig-Erhard-Str. 18, 20459 Hamburg (the “Provider”) and users of the Aydin Academy platform (the “Customer”).
A consumer is any natural person who enters into a legal transaction for purposes predominantly unrelated to their commercial or self-employed professional activity (section 13 of the German Civil Code). Deviating terms of the Customer do not become part of the contract.
§ 2 Services
The Provider supplies digital learning content through the platform, including video courses, lessons, quizzes, documentation, certificates and digital products. The specific scope of services is determined by the respective course or product description at the time of ordering. Free content may be changed or discontinued at any time.
§ 3 User account
A user account is required to use the platform. The Customer must provide truthful information and keep their login credentials confidential. The account is personal and non-transferable. The Provider may suspend accounts in the event of serious breaches of these Terms.
§ 4 Formation of contract
The presentation of courses does not constitute a legally binding offer. By clicking “Order with obligation to pay” or an equivalently labelled button, the Customer submits a binding offer. The contract is concluded upon confirmation of the order by email or activation of the course. The language of the contract is German.
§ 5 Prices and payment
All prices shown are final prices including statutory VAT. Payment is made through the payment service providers offered (for example Stripe or PayPal). For subscriptions, payment is due in advance for each billing period. Invoices are provided electronically.
§ 6 Rights of use
Upon full payment, the Customer receives a non-exclusive, non-transferable right to use the purchased content for personal learning during the agreed period. Downloading, reproducing, distributing or making the content publicly available, as well as sharing login credentials, is prohibited.
§ 7 Duration and termination
Courses purchased on a one-time basis are available for the duration stated in the course description. Subscriptions may be cancelled at any time with effect from the end of the current billing period, through the account or by email. The right to extraordinary termination for good cause remains unaffected.
§ 8 Right of withdrawal
Consumers have a statutory right of withdrawal. Details are available in our withdrawal information.
§ 9 Availability and warranty
The Provider strives to keep the platform available with as few interruptions as possible. Maintenance and disruptions beyond the Provider’s control may result in temporary restrictions. Statutory warranty rights for digital products apply (sections 327 et seq. of the German Civil Code).
§ 10 Liability
The Provider has unlimited liability in cases of intent or gross negligence and for injury to life, body or health. In cases of slightly negligent breach of essential contractual obligations, liability is limited to foreseeable damage typical of the contract. Liability under the German Product Liability Act remains unaffected.
§ 11 Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of mandatory consumer protection provisions of their country of habitual residence. If individual provisions are invalid, the validity of the remaining provisions remains unaffected.
